This fee covers all documentation preparation, lender research, application packaging, and lender introduction services. It is payable upon submission of your completed application. No refunds once the application has been submitted to a lender.

This agreement is between LHA Holdings Ltd trading as Creative Finance Consultants ("the Consultant") and the applicant named in this form ("the Client").
SERVICESThe Consultant agrees to provide the following services: (a) Review and assessment of the Client's project and finance requirements; (b) Preparation and formatting of a complete loan application package; (c) Research and identification of suitable lenders from the Consultant's network; (d) Introduction of the Client to a suitable lender upon completion of due diligence; (e) Ongoing communication support throughout the application process.
IMPORTANT NOTICEThe Consultant is NOT a registered financial adviser, mortgage broker, or licensed Financial Advice Provider (FAP) under the New Zealand Financial Markets Conduct Act 2013. The services provided are consulting and facilitation services only. The Consultant does not provide regulated financial advice. All lending decisions are made independently by licensed lenders. Clients are encouraged to seek independent financial advice.
CONSULTING FEEThe Client agrees to pay the consulting fee calculated as follows:
• Loan amounts $300,000 to $999,999: 2.0% of requested loan amount
• Loan amounts $1,000,000 to $1,999,999: 1.5% of requested loan amount
• Loan amounts $2,000,000 and above: 1.0% of requested loan amount

This fee is payable at the time of submitting this application and is non-refundable once the Consultant has commenced preparation of the application package.
REFERRAL DISCLOSUREThe Consultant may receive a referral fee from lenders in its network upon successful loan settlement. This is in addition to the consulting fee paid by the Client. The Consultant will disclose the identity of any lender to which the application is referred prior to submission to that lender.
LENDER DISCLOSUREThe Consultant works with a network of specialist lenders in New Zealand and the United States. Specific lender details will be provided to the Client at the point of referral, after the application package has been completed.
JURISDICTIONFor New Zealand clients, this agreement is governed by New Zealand law. For United States clients, this agreement is governed by the laws of the state in which the subject property is located.
PRIVACYAll personal information collected is handled in accordance with our Privacy Policy. Client information will not be shared with any third party until the Client has received and approved the lender referral in writing.
NO GUARANTEEThe Consultant does not guarantee loan approval. Facilitation services are provided on a best-efforts basis.
DISPUTE RESOLUTION (NZ clients)Any disputes will be referred to mediation under the New Zealand Arbitration Act 1996 before any court proceedings are commenced.
